A fake Communication Authority of Kenya (CA) engineer has been charged with posing as a genuine employee of the authority.
Mr Francis Tonny Mwai was charged before a Milimani law courts magistrate Ms Joan Mati with one count of personation.
Mr Mwai who was unrepresented denied that on August 7 and 13 this year Meiso Company Offices at Zahra Plaza in River Road Nairobi County he pretended to be an Engineer from CAK.
A prosecuting counsel Ms Evalyn Mutisya told the trial magistrate that Mr Mwai knew that he was not an officer nor an employee of the communication authority.
“Mr Mwai intended to deceive the employees of Meiso Company that he was an employee of CAK, yet knowing he was not,” Ms Mutisya told the court.
Mr Mwai who was arrested on August 13,2026 by police officers attached to CAK urged the court to free him on bond saying he was not a flight risk.
Urging the court to release him on reasonable bail terms, the accused said he is attending to his sick mother plus his wife whom he said was hypertensive.
Besides attending to his ailing parent and wife, the accused also said he was taking care of his school going children.
“I am the sole breadwinner for my family. Besides my immediate family members I am also taking care for my late sisters children who are in college. I pray you consider releasing me on reasonable bail terms preferably a cash bail,” urged Mr Mwai.
The prosecutor who said that the accused was trading as Eng Antony F M Mwai did not oppose his application seeking to be freed on reasonable cash bail.
In a brief ruling the magistrate noted that the prosecution did not oppose the bail plea by the accused.
Ms Mati said bail is a constitutional right that can only be taken if the prosecution presents compelling evidence to warrant the court to invoke its discretion in the prosecutions favor.
She proceeded to grant him bond of Sh500,000 with one surety of similar amount.
Ms Mati also gave him an alternative cash bail of Sh100,000 until August 28,2026 when he will return to court for pre-trial directions.
Meanwhile a fake gold dealer has been charged with defrauding an international company of $225,100 (KSh29million) claiming he was in a position to export a total of 150 kilograms of gold to a Dubai-based jewelry dealer.
Fred Obach Oliech faced three counts: conspiracy to defraud, obtaining money through trickery, and benefiting from the proceeds of fraud.
Oliech was charged before Milimani Law Courts Magistrate Teresia Nyangena .
He faced three counts
The prosecution alleged that between June 23 and 25 June 25 2026, within Nairobi County, Oliech and an accomplice conspired to defraud Kais Lahyani – representing Oro Trading Fze IIc.
Mr Lahyani filed a complaint then travelled to Nairobi on July 29, 2026 to testify in the case against Mr Oliech in court.
“Mr. Kais, who resides in the UAE frauding an international company of $225,100, equivalent to Sh29 million, claiming he would export 25 kilograms of gold to the Dubai-based jewelry dealers.
Fred Obach Oliech is facing three counts conspiracy to defraud, obtaining money through trickery’.
The accused allegedly benefited from the alleged proceeds of fraud.
Oliech was charged before Milimani Law Courts Magistrate Teresia Nyangena August 3, 2026, for these accounts.
Between June 23 and 25 2026 within an unknown area in Nairobi County, Oliech and an accomplice alleged tricked Oro Trading Fze Loc a sum of USD ($) 225,100 (KSh29million) a fact he knew to be false.
Police investigating the case discovered Oliech had already spent Sh16 million before his bank account was frozen.
The case will be mentioned within a fortnight to allocate a trial date.
Meanwhile the prosecution was ordered to supply the accused with witrness statements and copies of exhibits to enable the accused prepare for his defence.
