A man who was arrested with 10 litres of an illicit brew known locally as Murambe was on Wednesday spared a prison term after he confessed that the alcohol was for personal consumption and not for sale.
“Your honour the contents in this 10 litre jerrican was not for sale. It was for my own consumption,” Samuel Musyoki told Milimani Law Courts Magistrate Irene Ithamari.
The confession by Musyoki which the court presumed it was a plea of not guilty, jolted both the court and the prosecution.
Ms Ithamari consulted with the prosecutor about the penalties imposed under the law.
Musyoki was charged with flouting the law by being in possession of illicit alcohol contrary to Section 31(2)(b) as read with Section 31 (3) of the Alcohol Drinks Act of 2010.
After consulting, the trial magistrate directed the accused be remanded in custody to enable police charge him properly and also to take the substance for analysis at the government laboratory.
Musyoki was given a bond of KES 150,000 with an alternative cash bail of KES 35,000.
The charge stated that he was found with the 10 litre Jerrican of an illicit brew known as Murambe in Embakasi on October 6, 2026.
The illicit brew was produced in court by a police officer as exhibit.
The case will be mentioned on October 9, 2026, for further directions.
Musyoki who changed plea first admitted the charge.
