The Kenya National Commission on Human Rights (KNCHR) has been enjoined in the case in which police have been sued for allegedly abducting four men whose location is yet to be known.
At the same time Milimani High Court Judge, Justice Alexander Muteti, directed that the Inspector General of Police (IG) and the Director of the Directorate of Criminal Investigations (DCI) to attend court in person on August 17, 2026, to explain where the four men are.
The order to have the top echelons in the police force was issued following application by lawyer Abner Mango for the victims’ families.
Mr Mango told the judge even though the IG and DCI have claimed the four men- Michael Oloo Osoro, Evans Otieno Omondi, Macmillan Kiarie Mugo and Abdul Aziz alias Zizo-are not in their custody “their families believe it is police who are holding them incommunicado.”
The lawyer said parents of the victims and Independent Policing Oversight Authority (IPOA) believe it is police who took away their sons.
Earlier, the IG and DCI disclosed to the court “the missing persons referred to in that matter are not in police custody.”
The Law Society of Kenya (LSK) plus lawyers Ian Mutiso and Abner Mango for the victims urged the judge to order the IG and DCI to attend court in person to explain the whereabouts of the missing persons arrested and bundled into black Subaru SUVs.
“I urge this court to order IG Douglas Kanja and the director DCI to attend court in person to explain who arrested the missing persons in this matter before court, if not police,” Mr Mutiso told the trial judge.
Mutiso urged the judge to take judicial notice of the return of abductions which are being executed in the most-cruel manner.
LSK and Mango prayed to the court to stamp its authority and hold the IG and DCI responsible for the missing persons.
“The IG and DCI should not be allowed to get away with this matter. Kenyans want to hear from the two where these four innocent Kenyans are,” the LSK lawyer submitted.
The judge ordered the IG and DCI to file evidence explaining the whereabouts of the missing persons.
The judge also ordered the IG and the director DCI to attend court in person on August 17 and 18, 2026.
Meanwhile, the judge has asked relatives of the missing persons and also the activists to behave in an orderly manner whenever in court since their issues are being handled by the court.
“Calm is encouraged to enable the court go about its business in a peaceful environment. Shouting makes it difficult for me to follow the proceedings amidst this drama,’’ the judge said in respect of recent skirmishes and drama which saw an activist Julius Kamau derobe in court.
Relatives of the four - Oloo, Otieno,Mugo and Zizo - moved to court seeking orders to compel the IG, DCI, the Officer Commanding Buruburu Police Station, the Attorney General and IG Kanja to produce the suspects in court.
