The owners of a building in South C Nairobi which collapsed killing two people have been charged with manslaughter.
Abdishakur Muse Mohammed and Yussuf Mohammed Yussuf were charged alongside Eng Daniel Alphonse Odhiambo and Gedion Chege Gakundi alias Gideon Chege Mwangi with manslaughter.
At the same time, a sacked Nairobi County Urban Planning Officer Patrick Analo Akivaga from whose house Sh 65million was recovered by the Ethics and Anti-Corruption Commission (EACC) investigators, has been summoned to take plea for allegedly authorizing illegal construction of the killer house.
Besides Akivaga, Milimani senior principal magistrate Pauline Mugo also summoned Fredrick Ondari Ochanda, also a Nairobi County Urban Planning and Technical Committee member, to appear in court on July 27, 2026, to plead to charges of abuse of office.
Prosecuting Counsel Hilary Isiaho told the court that the Director of Public Prosecutions (DPP) has authorized the charging of 10 suspects over the collapse of Mamzil Towers.
“The DPP approved the charging of 10 suspects over the collapse of the ill-fated building which left two dead,” Mr Isiaho told the trial magistrate.
However, the prosecutor said only four suspects have honoured police summons to appear in court to plead to 17 criminal charges drawn against them by the DPP.
Mr Isiaho said six out of the 10 failed to turn up in court to answer charges filed against them.
He applied for courts to be served on the six to attend court on July 27,2026.
The four- Abdishakur Muse Mohammed, Yussuf Mohammed Yussuf, Daniel Odhiambo and Gedion Chege Gakundi- were charged with manslaughter contrary to section 202 as read with Section 205 of the Penal Code, Chapter 63 Laws of Kenya.
The court heard that on January 2,2026 at South C in Lang’ata sub-county the four unlawfully killed Ali Adan Galgalo Abdi and Hassan Huka.
Abdishakur and Yussuf were jointly charged with forging a notification of approval of application number PLUPA-BPM-002115-N for permission to carry out change of use.
The alleged application of approval was made on March 23, 2023.
They faced another joint count of fraudulently posting to the National Construction Authority (NCA) Online Projects Registration Sytemo Portal, the fake approval application PLUPA-BPM-002115-N for permission to carry out change of use.
Further DPP states Abdishakur and Yussuf unlawfully forged a Geotechnical Investigations report on February 24,2021.
The sixth chargew against the two was that on November 4,2023 at the NCA Offices within Nairobi they presented the fake Geotechnical Investigations report.
On July 11,2025 the duo denied forging a certificate of registration of a building or a construction site of directorate of occupational safety and health service.
Again Abdishakur and Yussuf were charged with making a fake Enviroment Impact Assessment License registration number 6927232 dated March 17,2023.
A nineth charge against the two was that of presenting the Environment Impact Assessment License registration number 6927232 to NCA alleging it had been issued by the National Environment Management Authority (NEMA).
All the four were charged with commencing the construction of Mamzil Towers on land reference number 209/5909/10 (Nairobi Block 68/1306) without Enviroment Impact Assessment License in the month of February 2024.
Analo’s lawyers Danstan Omari and Shadrack Wambui told the magistrate he was not available to plead to the charges on July 14, 2026.
“Our client Patrick Analo Akivaga is not present in court to plead to the charges. He is out on a police cash bail and we shall avail him at the appropriate time as he is seeking other reliefs at the High Court,” Mr Omari informed the court.
The four denied the charges against them and applied to be released on bond.
The prosecution did not oppose their release on bond.
Ms Mugo granted the four to deposit bond of Sh5 million with one surety of similar amount.
She directed the case to be mentioned on July 27, 2026, and also ordered police to refund the cash bails paid to them by the suspects when they were undergoing investigations.
