Police fish out 10th suspect in Dr Mutiso murder case

| Criminal

This comes as Rose Mbithe and Angella Mulwa refused to plead virtually over the same murder case.

The police net has fished out a tenth suspect in the brutal murder of clinical psychiatrist Dr Victoria Mutiso, 57 days after she was killed.

He has been charged with her murder.

At the same time, Rose Mbithe Mulwa, alias Rose Mbithe Ndetei, and her daughter, advocate Angella Mulwa, declined to plead virtually from Langata Women's Prison.

Mr Maritim Kimutai, alias Kim, the latest suspect to be arrested and charged, will be charged alongside the nine suspects already arrested over the violent killing of the senior mental health specialist.

Kimutai, who was physically presented at Milimani High Court, was returned to prison until September 29, 2026, when he will be jointly charged with the other suspects.

Those arrested over Dr Mutiso's death are: a former co-wife, Rose Mbithe Mulwa alias Rose Mbithe Ndetei, her children Chris and Angella (both lawyers), Police Constable (PC) Elijah Kibellion Kimoi, PC Collins Kiplagat Bett, Pius Muiru Mbugua alias Headboy, Samuel Karanja Gathoni alias Wakili (a law student), Daniel Mwangi Njoroge, and Kelvin Ngugi Kinuthia.

When the case was mentioned virtually on September 23, 2026, for plea-taking before Justice Alexander Muteti, a prison officer disclosed that Rose and Angella had refused to answer the murder charge virtually.

"My lord, the two have refused to appear before the court virtually," the officer told the court.

Following the officer's disclosure, Justice Muteti stated that there was an order by Justice Kanyi Kimondo for the suspects to appear virtually before him. He further noted that the suspects had no right to refuse to appear before his court virtually.

Defence lawyer Danstan Omari apologised to the court for his clients' conduct.

"My lord, they have no power to direct the court; we apologise for that," Mr Omari submitted.

Besides Omari, other lawyers appearing for Rose and her children are Katunga Mbuvi, Cliff Ombeta, Samson Nyaberi and Shadrack Wambui.

Prosecuting counsel Jalson Makori informed the court that they would be making an application to consolidate all the files relating to the same matter. Mr Makori said the DPP would be seeking an order to consolidate the case against PC Kimoi with that of Rose Mbithe, Chris Mulwa and Angela Mulwa.

Lead investigator Corporal Romana Oduor is compiling the committal bundles for all the suspects arrested in connection with the murder of Dr Mutiso, which occurred on July 29, 2026 along Mawensi Road, to enable the DPP to commence the trial.

On 27 August 2026, Justice Kanyi Kimondo directed that all those linked to the murder of Dr Mutiso be subjected to mental examination at Mbagathi Mental Hospital, or any other hospital offering the same services within Nairobi, to establish whether they were fit to stand trial. Following these directions for mental assessment, the court deferred plea-taking to September 23, 2026, before Justice Muteti.

Justice Muteti has since deferred plea-taking to September 29, 2026, at 12 noon, and ordered that all the suspects in the matter be produced physically for plea-taking. He also ordered that Kimutai be detained at Industrial Area Remand Prison until 29 September 2026, when he will be arraigned for plea-taking.

Justice Kimondo barred the suspects from commenting on the matter until they had been assessed as mentally fit to plead to the charge. "This court has been informed that a charge of murder has been preferred against the suspects. They are hereby required not to make any comment in respect of the case before mental assessment at Mbagathi, or any other hospital within Nairobi County," Justice Kanyi directed.

According to the DPP, on 29 July 2026, at about 9.30am along Mawensi Road in Kilimani Sub-County, Rose and her two children, together with others not before the court, murdered Dr Nthunya Mutiso.

Three key suspects who had gone on the run over the gruesome murder of Dr Mutiso were deported after being convicted by a Ugandan court of being in that country illegally.

The fugitives, PC Bett, Mbugua and Gathoni, are undergoing intensive interrogation by the Homicide Investigations Bureau at the Directorate of Criminal Investigations (DCI).

They were convicted by the Chief Magistrate of Buganda Road at City Hall on August 31, 2026, before being handed over to Interpol in Kampala, who then handed them over to Kenyan police at the Malava border on September 1, 2026.

They were produced in Court Seven after Ms Rose Mbithe Mulwa, alias Rose Mbithe Ndetei, her children Chris and Angella Mulwa (both advocates), and Police Constable Elijah Kibellion Kimoi were charged with murder before Justice Kanyi Kimondo, then remanded until September 23, 2026.

Ms Angella Mulwa was separately charged on September 2, 2026, at Mavoko Law Courts, Machakos County, over the theft of motor vehicles from the residence of the slain doctor at Mlolongo.

She had been arrested alongside Nelson Masiga Makaralu last month, where police investigated her over the theft of top-of-the-range vehicles belonging to Dr Mutiso, forgery of title documents, and malicious damage to property during the deceased's eviction from the KES 1.5 billion, 20-acre Mlolongo property.
