It is as crystal as daylight that an advocate, her mother and brother will face trial over the gangland style of murdering in cold blood, one of Kenya's finest psychiatrists, Dr Victoria Nthunya Mutiso.
Without mincing words, two senior assistant directors of public prosecutions, Jalson Makori and Gikui Gichuhi, told a magistrate that Angella Mbuwa, her mother Rose Mbithe Mulwa alias Rose Mbithe Ndetei and Chris Mulwa, will be presented at the High Court Criminal Division to stand trial for the heinous killing of the former celebrated top mental medic.
Dr Mutiso was felled by a gun-man -whom homicide detectives discovered is a police officer- PC Kimoi.
Two other police officers allegedly involved in the murder are on the run.
Mbithe and her son Chris on August 25,2026 will be presented before magistrate Geoffrey Onsaringo for directions when to be arraigned at the High Court to answer the capital offence whose penalty is death sentence upon conviction.
Once charged both Rose Mbithe, a presidential hopeful for the 2027 general elections and a 2022 gubernatorial loser and her daughter will be detained at Lang'ata Women prison.
During the 2022 Machakos Gubernatorial polls, Rose Mbithe emerged 5th with slightly over 4,000 votes against Wavinya Ndeti's over 220,000 votes landslide win.
That will be their home for as long as the case will be pending in court.
On Monday after three dramatic re-arrests and two short-lived freedoms lawyer Angella Mulwa will eventually stand trial for the heinous cold blooded murder of one of the country’s top mental medics executed in a gangland style.
Ms Mulwa, the director of public prosecutions (DPP) Renson Ingonga disclosed before a Milimani Law Courts magistrate Joan Mati, that she (Angella) will be charged alongside her mother-Rose Mbithe Mulwa alias Rose Mbithe Ndetei and her brother, Chris Mulwa, who is also an advocate.
Immediately, after the dismissal of Angella's application to prohibit the DPP from presenting her before Onsaringo alongside her mother and brother Mr Makori and Ms Gichuhi disclosed that a murder charge has already been registered at the High Court.
Angella was re-arrested immediately and escorted to DCI had quarters for formal charging.
Her arrest came hot on the heels of a dismissal of her bid to prohibit Ms Mati granting DCI homicide detectives 14 days to detain her and interrogate her over death of Dr Mutiso on July 29, 2026.
Prior to Monday's incident, Angella was on August 19, 2026, re-arrested at Mavoko Law Courts after she was freed on a cash bail of KES 1 million alongside Nelson Masiga Makaralu.
Both had been detained for 14 days when they were questioned about forgery of title property in respect of a Sh1.5billion parcel of land Mlolongo, theft of high-end motor vehicles belonging to the slain top psychiatrists and demolition to property.
They were freed by a Mavoko law courts resident magistrate Ms Lilian Kwamboka.
On August 20,2026, Angella, 53 was again presented before Ms Mati where DCI detectives sought 14 days to detain her for interrogations.
Ms Mati released her from custody pending determination whether she had jurisdiction to adjudicate over the police application it had been rejected by a Mavoko Court of equal legal status.
Defense lawyers Danstan Omari and Martina Swiga had opposed the police application saying it amounted to abuse of court process “by the galloping state.”
“This court lacks jurisdiction to entertain the police 14 days detention request as allowing such this court will be sitting as an appellate court yet is of equall jurisdiction,” Ms Swiga stated.
Mr Omari objected to the police plea saying “the state is now forum shopping for a suitable magistrate to entertain the application yet it is res judicater (already decided)”.
In her ruling on August 24, 2026, Ms Mati dismissed Angella’s objection to the state seeking her further detention saying “she has failed to establish legal thresh to allow her move to deter police from holding her for 14 days for interrogation.”
Ms Mati observed in her ruling that her Mavoko counterpart determined issues on forgery of documents in respect of the Mlolongo property, malicious damage to property and theft of motor-vehicles.
She ruled that police sought to interview her about the murder of Dr Mutiso.
Ms Mati allowed the DPP to proceed to argue its 14 days’ detention plea.
Mr Makori urged the magistrate to refer the case to be heard by a principal magistrate Geoffrey Onsaringo who ordered the mother of the lawyer-Rose Mbithe and Chris be detained for 21 days.
Their matter will be mentioned August 25,2026 for directions.
Mr Omari opposed the Angella matter being referred to Onsaringo who handled her mothers and brothers application saying “it (mbithe/chris application) is a totally different.”
“In the Mr Onsaringo matter-Angella is actually a lawyer for her mother and brother.The case is now being convoluted by the state,” Mr Omari.
Ms Mati adjourned the matter for 20 minutes to write a ruling but on resuming she did not even deliver the ruling as Mr Makori took a different trajectory leaving the defense and the suspect utterly shocked.
“Before you deliver the ruling I wish to bring to the courts attention that the DPP has registered a murder charge at the High Court in which Angella, her mother Rose Mbithe Mulwa alias Rose Mbithe Ndetei and Chris Mulwa will be called upon to answer for the murder of Dr Victoria Nthunya Mutiso,” Mr Makori.
He informed the magistrate that she is now functus officio (cannot handle the matter any further she has decided on the issue jurisdiction).”
Mr Makori said after the introduction of a murder charge at the High Court, the magistrate court cannot lay its hands on it.
“This court ceases to handle this matter. You are now released to the DCI officers homicide division,” Ms Mati stated.
Ms Angella was released to Corporal Romana Oduor and other officers from the homicide division of the DCI to record a statement awaiting production at the High Court for plea taking.
Detectives whisked her away from the courtroom and led to a waiting Subaru which sped off from the court parking bay at a break-neck-speed.
Mr Omari and Ms Swiga followed the Subaru car to DCI headquarters to witness her recording a statement under inquiry and formal charging.
Accoring to the information filed at the High Court criminal division, Angella, her mother Rose and brother Chris are charged that on July 29 around 9.30am along Mawenzi Road within Kilimani area jointly with others not before court they murdered Dr Victoria Nthunya Mutiso.
Besides the mother and her two children, police are also holding, Police Constable Elijah Kibellion Kimoi of Karinde Police Post which falls under Kikuyu Police Station, Daniel Mwangi Njoroge and Kevin Ngugi Kinuthia.
Njoroge is said to have been driving the Prado that blocked Dr Mutiso before Kinuthia driving a boda boda dropped Kimoi who shot the medic at close range.
Detectives are widening the manhunt for two police officers wanted over the last month's killing of Dr Victoria Nthunya Mutiso, with investigators enlisting Interpol to help trace the fugitives believed to be hiding in Uganda.
At the same time, fresh court filings reveal that the murder had been planned months earlier, with a KES 300,000 down payment allegedly made to the suspected killers on April 24 for the alleged murder to be carried out.
Inspector Kenneth Kipkemboi Sang and Police Constable Bett Kiplangat Collins remain at large as detectives pursue the alleged chain linking suspected financiers, police officers, gunman, driver and motorcycle rider.
Dr Mutiso, a prominent neuroscientist and former Director of Research and Administration at the Africa Institute of Mental and Brain Health (AFRIMEB), was shot dead on July 29, 2026, in Nairobi's Upper Hill area while travelling in an Uber.
Rose and Chris will appear on Tuesday before Mr Onsaringo for further directions. They had been detained at Kileleshwa and Kilimani police stations respectively.
