The Milimani High Court on Tuesday awarded tech entrepreneur and digital commentator Ndiang'ui Kinyagia KES 5 million in damages for violation of his rights during a June 21, 2025, police raid on his Kinoo home.
During the raid, the court heard that the officers seized his valuable electronic devices and personal documents.
Kinyagia came to national attention in June 2025 after he went into hiding when he learnt that the detectives from the Directorate of Criminal Investigations (DCI) were looking for him following social media posts linked to planned anti-government protests at the time.
He later appeared in court and said he had feared for his safety.
Justice Patricia Nyaundi in her ruling found that there was a breach of his rights to privacy, property, dignity, freedom and security of the person and freedom of movement.
She barred the Police and DPP from prosecuting him over what the court termed “unconstitutional investigative process”.
