A lawyer arrested and detained over the theft of high-end motor vehicles from the Mlolongo home of slain top mental medic Dr Victoria Mutiso has been released on a bond of KES 1 million with one surety of similar amount.
Ms Angella Mulwa was released on bond by Magistrate Lilian N Kwamboka after rejecting an application by the Director of Public Prosecutions (DPP) to have her detained for a further seven days.
Ms Kwamboka dismissed the application by the DPP saying “no compelling reasons were advanced to warrant the further incarceration of the suspect.”
The magistrate allowed the objection raised by lawyers Danstan Omari, Martina Swiga, Cliff Ombeta and Shadrack Wambui that police should not be allowed to detain further advocate Angella Mulwa.
“I urge this court to decline the plea to keep Angella for another minute in detention. She has been in custody for 14 days and serious crimes detectives should have completed their probe into the theft of the top of the range vehicles from the Mlolongo residence of the deceased,” Mr Omari submitted.
Ms Swiga said Ms Angella, who is an officer of the court, will cooperate with investigators to conclude the investigations.
Ms Swiga further said the suspect is willing to report to the investigating officer when required.
“The suspect is an advocate and not a flight risk. She will abide with bond terms which will be imposed,” Ms Swiga told the court.
She applied to free the suspects on bond saying it was their constitutional right under Article 49 (1)(h) of the Constitution.
Mr Omari undertook to avail the suspect to the investigators when “required by for interrogation.”
Mr Wambui said Ms Angella Mulwa is one of the lawyers representing her mother Ms Rose Mbithe Mulwa and brother Chris Mulwa who are still being detained for questioning over the killing of Dr Mutiso on July 29, 2026.
Police sought seven more days to finalise investigations.
They were also being held in relation to the shooting of Dr Mutiso.
Police are also establishing whether Angella and Nelson allegedlly forged eviction orders in respect of the Mlolongo property.
In her ruling Ms Kwamboka declined the DPPs plea to detain the suspects for a further seven days.
“The application to detain the suspects for further seven days is hereby rejected as no compelling reasons were adduced for extended detention,” ruled Ms Kwamboka.
The magistrate granted the suspects bond of KES 1 million each with one surety of similar amounts.
The suspects were ordered not to leave the courts’ jurisdiction.
“Pending completion of investigations you are hereby ordered not to interfere with investigations,” ordered the magistrate.
The suspects were further ordered to report to the investigating officer once a week until further orders of the court.
The matter will be mentioned on August 26,2026 for the police to inform the court the status of the investigations.
The 14 day’s detention orders granted to the police lapsed on August 19, 2026.
So far police are holding five suspects over the killing of Dr Mutiso, who was a ex-co-wife to Rose Mbithe Mulwa.
Mbithe divorced Prof David Musyimi Ndetei in 2001 and had been separated for 25 years.
Besides Rose Mbithe, her son Chris Mulwa, DCI officers also arrested Police Constable Elijah Kibellion Kimoi of Karinde Police Post whom detectives claimed is the one who shot dead Dr Victoria Nthunya Mutiso.
PC Kimoi was arraigned alongside Daniel Mwangi Njoroge and Kevin Ngugi Kinuthia.
PC Kimoi was detained for 30 days alongside Njoroge and Kinuthia to assist police to unearth the reasons and motive of the murder of the prominent neuroscientist on July 29, 2026.
Ms Rose Mbithe, 75, and her son Chris will appear in court on August 25, 2026, for police to state whether they have concluded their investigations and also whether the suspects will face murder charges.
